There is only one ground for divorce under Australian Family Law and that is irretrievable breakdown of marriage. This is established if the parties have separated and lived separately and apart for 12 months at least. Separation can include living under the one roof. But what is meant by "separation"?

One of the more difficult tasks that we confront is deciding when a couple is in a de facto relationship. There is no difficulty in proving, in almost every case, whether a couple is married or not. There is a marriage certificate. While de facto relationships can be registered, very few are.
